You may have received a violation that requires a Mandatory court appearance. Mandatory court does not mean mandatory trial. Over the last several years the Florida legislature has created a number of laws that prohibit your ability to elect traffic school. If you are alleged to have been speeding 30+ over the speed limit, involved in an accident where there is serious bodily injury or a fatality, or you were traveling with an uncovered/unsecured load, then you will have a mandatory court date within several months of your violation. In most cases the Clerk’s office will send you a notice of court hearing once they set a date for you in their system. The Florida Traffic Court Rules allow your attorney to appear for you in traffic court. In 2008, the Florida legislature passed an additional bill requiring a mandatory court appearance and hefty fines for motorists chaged with traveling 50+ over the posted speed limit. That law orders a Judge to impose a $1000 fine on a first offense, $2500 on a second offense, and a felony charge for the third offense.
